# Can DPJ take my child without a court order?

Under Québec’s Youth Protection Act (LPJ), the Director of Youth Protection (DPJ) can remove a child without a court order only in urgent situations where the child’s security or development is immediately endangered. This is permitted under sections 46 to 48 and 76 LPJ. The DPJ must bring the matter before the court within five working days to confirm the intervention. The court then decides whether the child remains in protective custody or is returned home under supervision.
