# Can I get divorced in Quebec if my spouse does not agree?

Yes. A divorce in Québec does not require both spouses to consent. Under section 8 of the Divorce Act, one spouse can apply on the basis that the marriage has broken down, most commonly established by one year of living separate and apart. Your spouse's refusal to agree may make the surrounding issues—parenting, support, or property division—contested, meaning a judge decides them, but it does not stop the divorce itself from being granted once the ground is proven. A spouse cannot hold the other in the marriage by withholding consent; what they can do is dispute the terms, which is a separate question from the dissolution of the marriage.
