Can Quebec enforce US custody orders?
Québec can recognize and enforce a U.S. custody order if the foreign court had jurisdiction, the parties were given a fair hearing, and enforcement aligns with the child’s best interests. The rules in C.c.Q. arts. 3155–3168 and the Civil Aspects of Child Abduction Act allow Québec courts to register and enforce valid foreign custody judgments. If the U.S. order was made under the Hague Convention, it can be enforced more rapidly through Québec’s Superior Court.
