# Do grandparents have custody rights in Quebec?

In Québec, grandparents do not have automatic custody rights, but the Civil Code of Québec (arts. 33 and 611) grants a child the right to maintain personal relationships with them unless there is a serious reason to restrict contact. Courts can award custody or visitation if the parents are unfit or absent and the arrangement is in the best interests of the child. Recent case law such as Droit de la famille – 191178 (QCCA 2019) confirms that contact with grandparents should enhance stability and emotional security, not disrupt parental authority.
