# Do family residence protections apply if we rent our home in Quebec?

For renters, the protections still matter but the analysis differs. Under articles 401 to 407 of the Civil Code of Québec, the family-residence protections apply to a leased home, so a spouse cannot unilaterally deal with the lease in a way that undermines the family's use of it, and rights to the lease can be allocated on separation. However, a simple residential lease is not itself a family-patrimony asset under article 415 C.c.Q., unlike an owned home, so there is no equal division of the lease's value. In short, renting affects what is shared, not whether the family residence is protected.
