# How is the partition affected when one spouse resides outside Quebec?

When one spouse resides outside Québec, the partition of family patrimony is governed by Québec law only for property located in Québec, such as the family home or local investments. Under C.c.Q. arts. 3083–3084 and 415–418, Québec courts have jurisdiction if one spouse is domiciled in Québec or if the property is situated there. Assets located abroad are subject to the law of the place where they are situated, which may limit enforceability of Québec judgments internationally. Spouses can also request recognition or homologation of Québec orders abroad under private international law mechanism
