# Is a cohabitation agreement legally binding in Quebec?

Yes. A cohabitation agreement is a contract, and a validly formed agreement is binding and enforceable between the partners under the general law of contracts in the Civil Code of Québec. Like any contract, it must meet the ordinary requirements—consent, capacity, and a lawful object—and how it is drafted has real consequences: a vague, incomplete, or one-sided agreement can create disputes or be open to challenge precisely when the partners rely on it. Because common-law partners have so few default protections in Quebec, the agreement's drafting carries the full weight of the parties' protection, which is why a lawyer-prepared or lawyer-reviewed agreement is worthwhile. Note that terms purporting to decide the children's custody or support cannot bind a court, which always applies the child's best interests.
