# Que se passe-t-il si l’un des conjoints a contribué davantage financièrement à l’achat des biens familiaux?

In Québec, under C.c.Q. arts. 415–418, property included in the family patrimony—such as the family residence and vehicles—is divided equally between spouses, regardless of who paid more. A higher financial contribution does not alter the equal division, as the law aims to recognize both spouses’ economic and non-economic roles during the marriage. Exceptions exist if an asset qualifies as excluded property (for example, an inheritance or gift under art. 423 C.c.Q.). Otherwise, even disproportionate investment in shared family property does not change the equal right to partition.
