What is a safeguard order and how do I request one?
In Québec family law, a safeguard order (ordonnance de sauvegarde) is a temporary emergency measure issued under C.p.c. arts. 49 and 510–511. It allows the court to respond quickly when a family’s situation requires immediate protection—for example, urgent custody arrangements, child support, or exclusive possession of the residence. The order remains in effect for a short period, usually 30 to 45 days, until the court can issue a provisional order. It is granted only when delay would cause serious harm to a child or spouse.
