# Which court handles divorce in Quebec?

In Québec, the Superior Court of Québec has jurisdiction over divorce under the federal Divorce Act. The application is filed in the judicial district of the spouses' common domicile or, failing that, the district of one spouse's domicile, in accordance with article 45 of the Code of Civil Procedure. Although divorce itself is federal, procedure is provincial: the Code of Civil Procedure, the rules of court, and the Civil Code of Québec apply to divorce proceedings insofar as they are compatible with the Divorce Act (see art. 517 C.c.Q.). The effects of the divorce—property division, support, and parenting—are then determined under Quebec civil law and the Divorce Act together.
