### Married spouses: separation and divorce are different

Living apart does not end a marriage. Divorce requires a judgment. Under [section 3 of the Divorce Act](https://laws-lois.justice.gc.ca/eng/acts/D-3.4/section-3.html), a court in a province can hear a divorce proceeding when either spouse has been habitually resident there for at least one year immediately before the proceeding begins.
